These terms form a binding agreement between you and Aai Shree Khodiyar Tour & Travels when you use our services or Site as described below. They are written in plain language but have legal effect. If anything is unclear, contact us before confirming a booking.
1. Definitions
- “Company”, “we”, “us”, “our”: Aai Shree Khodiyar Tour & Travels.
- “Customer”, “you”, “your”: the person or organisation making a booking, paying (if applicable), or using the service, and any passengers they authorise.
- “Service”: provision of a motor vehicle with a licensed driver for point-to-point, hourly, daily, or multi-day hire as agreed.
- “Site”: https://www.carhireinahmedabad.in and related subpages.
- “Booking confirmation”: written or recorded acceptance of a trip (including by WhatsApp, SMS, or email) specifying material terms or referring to an agreed quote.
2. Nature of service (chauffeur-driven only)
Unless we expressly agree otherwise in writing, all hires are with a professional driver. We do not offer self-drive rental to retail customers through this Site. You must not attempt to drive the supplied vehicle or allow anyone not authorised by us to do so.
Vehicle capacity, luggage limits, and roadworthiness are determined with reference to manufacturer specifications, permit rules, and safe loading. The driver's instructions on safety and legal limits override customer requests where there is a conflict.
3. Eligibility and authority
By booking, you represent that you are at least 18 years old and have authority to bind yourself (and, where applicable, your company) to these terms. If you book for other passengers, you confirm you have permission to share their names and contact details with us for operational purposes.
4. Quotes, fares, and inclusions
- Online lists, calculators (if any), blog figures, and verbal estimates are indicative unless confirmed as a fixed package in writing. Final price depends on route, date, time, vehicle class, tolls, waiting, night allowance, interstate permits, parking, and GST or other taxes applicable at the time of service.
- Inclusions and exclusions are only those stated in the Booking confirmation or the written quote referenced there. If something is not listed (for example “tolls included”), assume it is not included unless we confirm.
- Extra distance or time: if the trip exceeds agreed kilometres or hours (including unplanned diversions or extended waiting), additional charges apply at the rates we communicate at booking or at the then-current standard rate chart.
- Waiting time: grace periods and charges for airport/station pickups or in-city halts, if any, are as agreed. Chronic delays may require rescheduling or substitution of vehicle.
- Multi-day tours: driver rest, night halt rules, and accommodation for the driver (if applicable) must comply with law and the plan we agree. Customer-requested changes that increase driving hours may be refused on safety grounds.
5. Payments, GST, and invoices
We may accept cash, UPI, bank transfer, card via approved gateways, or other methods we specify. Advance payments or deposits may be required to secure vehicles during peak demand, weekends, or festivals.
Where applicable, GST will be charged and a tax invoice or bill of supply issued in line with Indian tax law. Corporate customers must provide accurate legal name, GSTIN, and billing address before invoicing.
You are responsible for any currency conversion, bank fees, or chargebacks initiated without valid dispute grounds. Fraudulent chargebacks may result in legal recovery and blacklisting.
6. Cancellations, changes, and no-shows
Cancellation, rescheduling, and no-show fees depend on the vehicle category, route, and how close the change is to pickup time. The specific policy for your booking is the one communicated in your Booking confirmation or the quote it refers to.
- No-show: if you are unreachable at the agreed pickup window and do not respond on the contact number provided, the driver may be released and charges may apply as per policy.
- Company cancellation: if we cannot perform due to force majeure, mechanical failure, or safety issues, we will use reasonable efforts to offer an alternative vehicle or refund prepaid amounts for the unperformed portion, but we are not liable for consequential losses beyond that.
7. Customer and passenger conduct
- Seat belts must be worn where fitted and required by law.
- Smoking, illegal substances, and excessive alcohol consumption in the vehicle are prohibited. We may terminate the trip immediately if behaviour endangers the driver, vehicle, or public, without refund of unused portions except at our discretion.
- Carrying hazardous materials, contraband, or overloaded luggage is prohibited. You are liable for fines or damage arising from concealed prohibited goods.
- Reasonable courtesy toward the driver is required. Abusive language, harassment, or discrimination may result in service termination and reporting to authorities where appropriate.
8. Damage, cleaning, and lost property
You may be charged for repair or professional cleaning if the interior or exterior is damaged or soiled beyond normal wear (for example spills, burns, vomit, dents from luggage mishandling) attributable to you or your guests.
Lost items may be held for a reasonable period. While we take care, we are not liable for cash, jewellery, or high-value items left in the vehicle. Claim lost property promptly with a description.
9. Delays, traffic, and force majeure
Arrival times are estimates. We are not liable for delays caused by traffic, weather, road closures, accidents, public events, strikes, pandemic restrictions, or other events outside our reasonable control. We will use reasonable efforts to reroute or communicate material delays when practicable.
10. Limitation of liability
To the maximum extent permitted by applicable law in India, the Company's total aggregate liability arising out of or in connection with a booking (whether in contract, tort, or otherwise) is limited to the fees actually paid by you to us for that specific booking, except where the law does not permit such a cap (for example liability for death or personal injury caused by our proven negligence, where such exclusion is void).
We are not liable for indirect or consequential losses, including missed flights or trains, lost profits, lost data, hotel costs, or alternative transport, except where such exclusion is unenforceable.
Third-party services (payment gateways, maps, airlines) are solely responsible under their own terms. We do not guarantee third-party performance.
11. Insurance
Commercial vehicle insurance is maintained as required by law. Coverage types and limits vary by vehicle and policy. Ask us before travel if you need written confirmation of insurance class for a specific vehicle. Insurance does not replace your need for personal travel or health insurance if you consider it necessary.
12. Subcontracting and assignment
We may assign drivers or affiliated operators to perform the Service, provided quality and safety standards are maintained. You may not assign your rights under a booking to another party without our written consent.
13. Website use, intellectual property, and acceptable use
- Site content (text, graphics, logos, layout) is owned by the Company or its licensors. You may not copy, scrape, frame, or mirror the Site for commercial use without permission.
- You must not probe, disrupt, or overload our systems; attempt unauthorised access; or use automated means to harvest data except public search engines indexing in line with our robots rules.
- Any enquiry or booking information you submit must be accurate and lawful. You indemnify us against claims arising from false or misleading information you supply.
14. Privacy
Personal data is processed as described in our Privacy Policy.
15. Dispute resolution and governing law
These terms are governed by the laws of India. Subject to non-waivable consumer rights, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction.
Before filing suit, you agree to attempt good-faith resolution by contacting us with a written summary of the dispute. We will respond within a reasonable time (typically 15–30 business days) with our position or a settlement proposal.
16. Severability, waiver, and entire agreement
If any provision is held invalid, the remainder remains in effect. Failure to enforce a provision is not a waiver unless in writing.
These terms, together with the Booking confirmation and Privacy Policy, constitute the entire agreement regarding the subject matter and supersede prior oral understandings to the extent of conflict.
